INQUIRY FOR SUPPLY OF MANPOWER This Inquiry for manpower supply from M/s. EMSATH LLC. having its registered office at Post Box No. 237713, Dubai, UAE And whereas the M/s EMSATH LLC.
Giving opportunity to your company to work with us as a business partner and supply Manpower in U.A.E. as per the terms and conditions set out hereinafter.
Nature of Sub Contract : Supply of Manpower (You can supply manpower in HVAC, MEP and CIVIL under any kind of category, Helpers, Pipe Fitter, Plumber, Electricians, Arc Welders, Welders, Fabricators, Insulators, Duct-man, Tile Meson, Machine Plaster Meson, Ordinary Meson, Carpenters, shattering Carpenters, Painters and any kind of Supervisors). Manpower Requirement : HELPERS More than 200 nos. Manpower Required.
The number of manpower is open and may increase as per requirement Pakistani, Indian, Nepali Nationality Only.
Working hours : Minimum 10 working hours shall be given to the workers daily @ agreed rate and exceeding more than 8 hours worked shall considered be as OT. Start Date : Within two Days (t Duration : One Year Contract. (The number of months is open and may increase as per requirement or decrease as per requirement) Category : Skilled and Unskilled (MEP, HVAC and CIVIL Projects) Rate : After Meeting will be finalize with LPO (Contract). Terms and Conditions
1. Employees Visa The Second party shall be responsible for visa and other documents for ensuring that the employee is legally authorized to work in UAE.
2. Scope of Work The Second Party supplied personnel shall work for the First Party on First party’s instructions and as per the site requirements of the First party or the group companies or under company contractor. They shall carry out the works under the Supervision of Contractor.
3. Employees The Second Party shall at all times provide suitable work force to the First party at the satisfaction of the First party.
4. Supervision The Second Party’s personnel shall at all time work under the Supervision and Direction of the First Party and shall follow all instructions and/or directions laid down by the First Party.
5. Safety Requirements The Manpower assigned to the site shall be fully equipped with Personal Protection Equipments as per the labour law. The Second Party shall provide the Personal Protection Equipments to the employees at the work sites. Any employee not following the safety instructions and thereby the fine imposed on the company the Second party is liable to compensate the First party for the same.
6. Tools All tools required for the work shall be provided by the contractor or First Party.
7. Damages/Missing Items Any Damages to the Works / Plants / Machineries / Tools etc, due to negligence and/or missing equipment / Materials / Tools and/or bad workmanship by the employee(s) of the Second Party the Second Party shall be responsible to get it rectified / repaired at their cost, failing which the rectification / repairing cost(s) including the materials shall be carried out by the First Party and shall be recovered from the Second Party.
8. Insurance The Second Party shall at all times effect and maintain a Workmen’s Compensation Insurance Policy covering death and/or injury to Workmen’s employed by them in accordance with the Local Laws and Extending to cover claims at Common Law subject to an unlimited limit of indemnity. The Second party shall ensure that the insurance covers all or any unforeseen accidents to the employee at the site.
9. Accommodation The First party shall provide the accommodation for the workers supplied by the Second Party.
10. Transportation The workers transportation to and from the site shall be the responsibility of First Party.
11. Absence from work The Second Party shall ensure that the workers attend the work without fail unless otherwise there is genuine illness certified by a government doctor and informed to the First Party officially. If no official communication is provided for the absence of the worker with supporting document, the First party shall have the right to return such workers and the Second Party should immediately replace another worker in his place. Minimum time for work order should not be less than two hundred twenty hours, if there are less work order found as said before then time sheet will not consider.
12. Replacement of Workers The Second Party shall take written permission from the First party for replacing any of supplied workers. If any of the supplied workers is sick / injured / handicap or any other problem found to be not fit for the job, then First Party will return back this worker to Second Party unpaid as mutually agreed.
13. Payment shall be made, by way of Account Payee Cheque only, by the First Party to the Second Party after 45 days from the date of submission of Invoice.
14. Termination of Contract If any of the parties wishes to terminate the contract, the party who wishes to do so shall provide a notice in writing to the other party one month in advance.
15. Language All written communications and documents between the parties shall be in English language.
16. Governing Law This agreement shall be construed in total and if any If any of the points in this agreement is inconsistent with the laws of UAE, the Laws of UAE will prevail and the clauses to that particular point shall be declared void and all the rest clauses shall survive. Any claims or objections arises out of this agreement the same shall be amicably settled between parties within a month and if the differences of opinion still exists the same shall be governed by the laws of UAE and Courts in Dubai shall have the absolute jurisdiction for the same Laws of UAE shall govern the Laws of this Agreement.
17. Modification and Notice Any or all modifications, corrections, addendum, amendment or alterations to the terms and conditions of the agreement between the parties shall be in writing and with the consent of both parties upon giving a proper notice.
